You should know that these drivers have no special commercial driver’s license and have no restrictions on the number of hours they may drive during a given day. All Virginia drivers will soon be required to have auto insurance in order to drive on Virginia roadways. Recent legislation passed in this year’s General Assembly repealed allowing uninsured drivers to simply pay a $500 uninsured motorist fee. Those uninsured drivers who cause injury to others on the roadway do not have the insurance to pay damages to those they injure. The new law prevents this from happening when all uninsured registrations expire July 1, 2024. After that date, all drivers will be required to have auto insurance in order to pay for damages caused to those who are injured through no fault of their own. Justice is well served by this new legislation.

SMALL CLAIMS JUST GOT BIGGER – As of July 1, 2021 the General Assembly passed legislation allowing Virginia General District Courts to increase the maximum amount that can be sued for from $25,000 to $50,000. General District Courts are generally considered “small claims courts.” But now, for clients who are involved in less serious collisions, we can take the case to General District Court for up to $50,000 without the delay and expense that we would have incurred going to the Circuit Courts (which will handle all amounts above $50,000).

BOTTOM LINE: With this new legislation taking effect today, smaller cases will now be heard in the General District Court, allowing for an earlier trial date with less cost to the client and a greater chance for a larger verdict.

COUNTERFEIT face masks/respirators are being falsely marketed and sold as legitimate masks; however, they don’t provide the same protection against Covid. Here’s how to spot counterfeits:

  • No markings at all on the filtering facepiece respirator (NIOSH-approved respirators have an approval label on or within the packaging of the respirator
  • No approval (TC) number on filtering facepiece respirator or headband
  • No NIOSH markings
  • NIOSH spelled incorrectly
  • Presence of decorative fabric or other decorative add-ons (e.g., sequins)
  • Claims for the of approval for children (NIOSH does not approve any type of respiratory protection for children)
  • Filtering facepiece respirator has ear loops instead of headbands

No one wants to think about being involved in a tractor trailer collision, but they unfortunately do happen. What to do immediately after the collision:
1. Evaluate any injuries.
2. Call 9-1-1.
3. If possible, remove your car from the road. Determine if you can exit your car and safely move to a better location. If not, remain in your car with the seatbelt fastened until the police arrive.
4. Report all facts and notify police and paramedics of any pain.

The FDA has recalled and listed 75 hand sanitizers tainted with methanol to avoid. Even some hand sanitizers that listed ethyl alcohol as the main ingredient tested positive for methanol, also known as wood alcohol, which is toxic when absorbed through the skin and fatal when ingested. If you have any of these hand sanitizers on the list, the FDA asks that you do not throw them down the drain. Although Virginians are traveling less and covering fewer miles, it turns out that emptier roads are riskier roads. Less traffic on the road shouldn’t mean more fatalities. But that’s exactly what’s happening. According to VDOT, speed and the lack of seatbelt usage has caused a surge in fatalities on Virginia roadways. In 70 percent of all speed-related fatalities, travelers were not wearing seatbelts, which is an increase of 78 percent since last year.

Please be mindful, don’t take chances, and remember the decrease in traffic volume doesn’t mean open season for reckless driving. Words from VDOT worth remembering:

  • Buckle up
  • Avoid distractions
  • Share the road; be aware of pedestrians and bicycles
  • Obey speed limits
